NEGLECT OF ELDERLY PARENTS BY BIOLOGICAL CHILDREN ACCORDING TO ARTICLE 49 OF LAW NUMBER 23 OF 2004 CONCERNING THE ELIMINATION OF DOMESTIC VIOLENCE FROM A VICTIMOLOGY PERSPECTIVE

Abstract

Neglect of the elderly by biological children is a phenomenon that invites victimological attention, especially in the context of Law Number 23 of 2004 concerning the Elimination of Domestic Violence, especially Article 49. This neglect creates serious impacts on the physical, emotional, and social well-being of the elderly and creates vulnerability to other risks, such as increased levels of depression and decreased quality of life. The purpose of this study is to analyze the neglect of the elderly by biological children in terms of Law Number 23 of 2004 concerning the Elimination of Domestic Violence based on a victimological approach. The method used is qualitative with a normative legal approach. The data analysis technique uses descriptive analysis techniques. The conclusions of this study are: 1) Where the background of a child abandoning parents who have entered the elderly stage can be understood in the context of Indonesian social and cultural life caused by economic factors because the child feels his burden is reduced when his parents leave home; 2) The physical and psychological impacts on the elderly who are neglected are very influential, they can experience various disorders, such as hypertension, hearing disorders, communication disorders, and visual impairment; 3) To enforce the law, the abandoned parents must file a lawsuit in court to request legal protection and compensation for the protection that was not received.
